writ of right 〈英〉 (1)权利令状 与「特权令状」相对的一类令状。这类令状根据1215年的《大宪章》〔Magna Carta〕国王有义务签发,以别于根据国王的恩典或法庭的自由裁量权签发之特权令状。权利令状可分为两种,即诉讼开始令〔original writ〕和司法令〔judicial writ〕。 (→writ; prerogative writ; original writ; judicial writ) (2)回复土地所有权令 古代不动产法上的一种为救济非限嗣继承地产所有权人而签发的不利于现行占有权人的令状。该令状可适用于任何非法强占土地之情形,但实际上仅用于土地所有权人失去了其进占权〔right of entry〕或占有权〔right to possession〕之情形,因为在其它情况下申请回复土地占有令〔writ of entry〕更加便利。该令状之所以被称为回复土地所有权令,系由于所有权人仍保留有土地所有权,只不过这种所有权通常是一种失去了占有权的名义上的土地所有权〔mere right〕。1833年这种令状在英格兰被废止。
